These Terms of Service ("Terms") govern your use of the Tiggabyte website (tiggabyte.com), the FileForge desktop application, and any related services (collectively, the "Services") provided by Tiggabyte ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.
1. Account Registration
To access certain features of the Services, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials confidential
- Be responsible for all activity under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
2. Software License
Use of the FileForge desktop application is governed by the FileForge End User License Agreement (EULA), which is presented during installation and available within the application. The EULA is incorporated into these Terms by reference.
Key license terms:
- Licenses are per-user and require authentication via your Tiggabyte account
- The software requires periodic internet connectivity for license validation
- An offline grace period of 72 hours is provided between validations
- Licenses may be assigned directly or through an organizational account
3. Subscriptions and Payments
3.1 Billing
FileForge licenses are offered on a subscription basis (monthly or annual). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
3.2 Pricing
Current pricing is available at tiggabyte.com/fileforge. We may change pricing with reasonable advance notice. Price changes do not affect your current billing period.
3.3 Cancellation
You may cancel your subscription at any time through your account page. Upon cancellation:
- Your license remains active until the end of the current billing period
- No refunds are provided for partial billing periods
- After expiration, the software's tools will require a new subscription to access
3.4 Refunds
Refund requests are handled on a case-by-case basis. Contact support@tiggabyte.com within 14 days of purchase if you are unsatisfied with the Services.
4. Acceptable Use
You agree not to:
- Share, sell, or transfer your account credentials to others
- Attempt to circumvent license enforcement or authentication mechanisms
- Use the Services in violation of any applicable law or regulation
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any part of the Services
- Use automated tools to scrape, crawl, or extract data from the website
5. Organizational Accounts
If you manage licenses on behalf of an organization:
- You represent that you have authority to bind the organization to these Terms
- You are responsible for managing license assignments within your organization
- Each license must be assigned to an individual named user
- Sharing of individual licenses between users is not permitted
6. Intellectual Property
All content, software, trademarks, and other intellectual property associated with the Services are owned by Tiggabyte or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Services without our express written permission.
7. Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the practices described in the Privacy Policy.
8. Service Availability
We strive to maintain high availability of the Services but do not guarantee uninterrupted access. We may temporarily suspend the Services for maintenance, updates, or other operational reasons. The FileForge desktop application includes a 72-hour offline grace period to minimize disruption during service interruptions.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIGGABYTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Termination
We may terminate or suspend your access to the Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your use of the Services at any time by canceling your subscription and deleting your account.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the website or email. Continued use of the Services after changes are posted constitutes acceptance.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict of law principles.
